These SMS / Mobile Terms (“Mobile Terms”) govern participation in Darn Good Yarn’s text messaging program (the “Program”). The Program is operated by Darn Good Yarn, Inc. (“Darn Good Yarn,” “we,” “us,” or “our”). By opting in to the Program, you agree to these Mobile Terms.

1) Program Description

By opting in, you agree to receive recurring text messages from or on behalf of Darn Good Yarn. Messages may include marketing and promotional messages (such as offers, product drops, back-in-stock alerts, cart reminders, and announcements), as well as operational and support-related messages (for example, when you contact us for help).

2) How You Opt In (Signup Methods)

You may opt in to the Program in a variety of ways, including through our website forms or pop-ups, at checkout, by entering your phone number in a subscription field, or by texting a keyword to a designated number (“text-to-join”).

3) Consent to Receive Automated Messages

By providing your mobile number and opting in, you consent to receive text messages from Darn Good Yarn, including messages sent using an automatic telephone dialing system or other automated technology. Your consent is not a condition of any purchase.

6) Supported Carriers & Delivery Disclaimer

You can cancel the Program at any time by replying STOP to any message. After you send STOP, we may send one additional confirmation message to confirm you have been unsubscribed. You will no longer receive text messages from the Program unless you opt in again.

9) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to participate. By enrolling, you represent that you are the authorized user of the mobile number you provide or that you have permission from the authorized user to enroll.

10) International Participation

The Program may be available to participants in the United States and internationally. However, not all mobile carriers or countries support all messaging features, and availability may vary. If you reside outside the United States, your participation may result in international messaging charges imposed by your carrier. Darn Good Yarn does not guarantee message delivery or Program availability outside the United States.

11) Promotions & Discounts

We may offer promotional discounts or incentives for enrolling in the Program. Offer terms will be provided at the time of the offer and may include limitations (for example: one-time use, exclusions such as gift cards, and non-combinability). 12) Privacy

We respect your privacy. Our collection and use of personal information in connection with the Program is described in our Privacy Policy.

We may use your mobile number, consent status, and messaging interactions (for example, delivery confirmations and whether messages are acted upon) to operate the Program, provide customer support, and measure the effectiveness of the Program. We may also use information about purchases and site activity to personalize messages and to measure marketing performance, subject to your cookie preferences and applicable opt-out rights.

13) Changes to the Program or These Mobile Terms

We may modify or discontinue the Program or update these Mobile Terms at any time. If we make material changes, we will update the Effective Date above. Your continued participation after changes become effective constitutes acceptance of the updated Mobile Terms.

14) Arbitration & Class Action Waiver

Please read this section carefully. It affects your rights, including your right to bring a lawsuit in court.

To the fullest extent permitted by law, you and Darn Good Yarn agree that any dispute, claim, or controversy arising out of or relating to the Program, these Mobile Terms, or the text messages sent under the Program (collectively, “Disputes”) will be resolved by binding individual arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

No class actions: You and Darn Good Yarn agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Arbitration procedures: The arbitration will be conducted by a nationally recognized arbitration provider under its applicable rules for consumer disputes. The arbitrator will have the authority to award any relief that would otherwise be available in court, on an individual basis only.

Severability: If any portion of this Arbitration & Class Action Waiver section is found unenforceable, the unenforceable portion will be severed, and the remainder will be enforced to the maximum extent permitted by law.

15) General

To the extent permitted by law, the Program is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free messaging.

These Mobile Terms are in addition to our Terms of Service and our Privacy Policy. If there is a conflict between these Mobile Terms and our Terms of Service with respect to the Program, these Mobile Terms control.
